Eaton man sentenced to 9 years on burglary and assault convictions

EATON —On Tuesday, Jan. 19, Angel Hernandez of Eaton was sentenced to 9 years in the custody of the Ohio Department of Rehabilitation and Corrections after being convicted on charges stemming from a Sept. 14, 2015, burglary.

Hernandez pleaded guilty to “aggravated burglary,” a felony of the first degree; “felonious assault,” a felony of the second degree and one count of “assault,” a felony of the fifth degree, according to a press release issued by Preble County Prosecutor Martin Votel.

The offense occurred on Monday, Sept. 14, in the city of Eaton, when Hernandez showed up at an Eaton residence and began banging on the door. The resident told the Hernandez to leave and threatened to call the police.

Hernandez then broke into the home through the kitchen window and broke down the bedroom door in order to reach the occupant.

According to records, Hernandez then held a knife to the occupant of the residence — a mother — and her five-year-old daughter, threatening to kill the child.

The release stated the resident and child were ultimately able to escape to a neighbor’s house.

Once in custody, Hernandez “punched a corrections officer at the jail,” according to the release, resulting in the additional charge of “assault.”

The State of Ohio was represented by Prosecuting Attorney Martin P. Votel in all stages of the case.

“Any man who would break into the home of a defenseless person and assault a five-year-old girl with a deadly weapon deserves to be segregated from society for as long as possible,” Votel said. “Angel Hernandez has a lengthy history of violent crime, including robbery and attempted aggravated assault with a handgun, and his behavior in this case is consistent with his violent nature. The Eaton Police Division did an excellent job investigating this case and ensuring that justice was done.”

Votel and the prosecutors sought the maximum sentence of 11 years’ incarceration, citing the nature of the offense and “defendant’s significant violent criminal history, including nearly 20 years served behind bars before committing the present offense,” officials noted.
