Council approves Green Tokai record plan

BROOKVILLE — Council approved the subdivision record plan for Brookville Industrial Park Section 2-B that will allow a lot owned by Green Tokai on Sakura Drive to be divided into two lots.

Law director Rod Stephan noted Green Tokai plans to sell 6.015 acres of the original lot to the C.F. Poeppelman Company.

“C.F. Poeppelman Inc, doing business as Pepcon, has submitted a special use application to construct a concrete mixing plant on Sakura Drive,” Brookville Law Director Rod Stephan said at the Nov. 16, 2023 planning commission meeting.

Planning commission on Nov. 16 voted 4-1 to approve the special use application.

Stephan said at the Feb. 6 council meeting before Green Tokai can sell the land to C.F. Poeppelman, “approval of the subdivision record plan is a necessary step in the proposed sale.”

Stephan noted planning commission approved the subdivision record plan at its Jan. 18 meeting.

“The subdivision record plan meets all of the zoning and subdivision regulations for the I-2 (Industrial) zoning district,” Stephan told council.

Councilmemember J.D. Fowler asked if there were any concerns with dust, specifically for the Brookhaven Retirement Community, which is located near the proposed location for the concrete mixing plant.

Stephan replied that the company has a contractual arrangement with Green Tokai to manage the dust.

Stephan also said the city zoning department can also check to make sure there are no dust problems.

“My only other concern is their hours of operation. When they are coming up and down Westbrook Road at 5 or 6 a.m., I’m assuming we have some kind of zoning ordinances in place that controls that,” Fowler asked.

Stephan said the company’s normal hours of operation is from 7 a.m. to 7 p.m.

“You are going to see at peak times some traffic coming through there, but we already have that in that industrial park,” Stephan added.

“Have there been any noise complaints from residents living on Westbrook Road?” Fowler asked.

“We have not had a lot of complaints from residents on Westbrook Road. We have had some complaints from residents on Albert Road from existing truck traffic,” Stephan replied.

Councilmember Kim Wilder asked if the weight of the cement trucks will damage the roads.

Stephan replied there shouldn’t be any problems with the weight of the trucks.
